These terms govern your use of Brixen HQ. We've written them in plain language so you actually understand what you're agreeing to.
By creating an account on Brixen HQ, you agree to these Terms of Service. If you do not agree, please do not use Brixen HQ.
These terms apply to all users of Brixen HQ, including gym owners, staff members, and any other account holders.
Brixen HQ is a cloud-based gym management software that helps gym owners manage members, attendance, payments, and staff.
We provide the service on a subscription basis. Features available depend on your chosen plan (Basic, Pro, or Elite).
We reserve the right to modify, suspend, or discontinue any part of the service with reasonable notice.
You are responsible for maintaining the security of your account credentials.
You must provide accurate information when creating your account.
You are responsible for all activity that occurs under your account.
You must not share your login credentials with unauthorized persons.
You must be at least 18 years old to create an account.
You may use Brixen HQ only for lawful gym management purposes.
You must not: use Brixen HQ to send spam or unsolicited messages, attempt to hack or reverse-engineer the platform, upload malicious code or content, or violate any applicable laws.
You are responsible for ensuring that your use of WhatsApp messaging features complies with WhatsApp's terms of service and applicable regulations.
Data about your gym members that you enter into Brixen HQ belongs to you.
You are responsible for obtaining appropriate consent from your gym members before entering their data into Brixen HQ.
You must not enter sensitive personal data beyond what is necessary for gym management.
Brixen HQ acts as a data processor on your behalf. You remain the data controller.
Brixen HQ is offered on a subscription basis (monthly, quarterly, or annual).
All prices are in Indian Rupees (INR) and exclusive of GST (18%).
Subscriptions automatically expire at the end of the billing period — there are no automatic renewals without your action.
We offer a 14-day free trial for new accounts. No credit card is required for the trial.
We offer a 30-day money-back guarantee for paid subscriptions.
Brixen HQ, its logo, design, and software are the intellectual property of Brixen HQ.
You may not copy, modify, distribute, or create derivative works of Brixen HQ.
Your gym data and content remain your property.
Brixen HQ is provided "as is" without warranty of any kind.
We are not liable for any indirect, incidental, or consequential damages arising from your use of Brixen HQ.
Our total liability to you shall not exceed the amount you paid us in the 3 months preceding the claim.
We are not responsible for any losses arising from: service downtime, data loss due to your actions, or third-party service failures.
You may cancel your account at any time from within the Brixen HQ dashboard.
We may terminate accounts that violate these terms, with or without notice.
Upon termination, you have 30 days to export your data before it is deleted.
These terms are governed by the laws of India.
Any disputes shall be subject to the exclusive jurisdiction of courts in India.
We may update these terms from time to time. We will notify you of significant changes via email at least 14 days before they take effect.
Continued use of Brixen HQ after changes constitutes acceptance of the updated terms.
